StencilMind Terms of Service

These Terms of Service (“Terms”) are the agreement between you and DualSpoke, a DBA of DualScript LLC, a Wyoming limited liability company, for your use of StencilMind at app.stencilmind.com. We have written them in plain language because you are an artist, not a lawyer, and you should be able to understand what you are agreeing to.
By creating an account or using StencilMind, you agree to these Terms. If you do not agree, do not use the service.
In these Terms, “we,” “us,” and “our” mean DualSpoke. “You” and “your” mean the person or business using StencilMind. “Content” means images you upload and the stencils the service produces from them.
1. What StencilMind Does
StencilMind converts artwork and reference photos you upload into print-ready tattoo stencils using AI image processing. The tool only converts the images you give it. It does not generate original artwork and does not create images from text prompts. What you put in determines what you get out.
2. Your Account
To use StencilMind you need an account. You agree to provide accurate information, keep your login credentials secure, and take responsibility for everything that happens under your account. You must be at least 18 years old and able to enter into a binding contract. StencilMind is built for professional and adult use.
3. Acceptable Use
You are responsible for the images you upload. By uploading an image, you confirm that you have the legal right to use it. Specifically, you agree that you will not:
- Upload any image you do not own or have permission to use, including copyrighted artwork, photographs, or designs you do not have rights to
- Upload any child sexual abuse material (CSAM) or any content that sexualizes minors
- Upload any content that is illegal, or use the service for any illegal purpose
- Attempt to break, overload, reverse engineer, or interfere with the service or its security
- Resell or redistribute access to the service without our written permission
If you violate this section, we may suspend or terminate your account immediately and without notice. Suspension or termination for a violation does not entitle you to any refund, including for unused conversions or the remainder of your billing period.
4. Intellectual Property and Ownership
This section matters, so it is short and direct.
- You own your uploads. You keep full ownership of every image you upload to StencilMind.
- You own your stencils. You keep full ownership of every stencil the service produces from your uploads.
- We claim no rights to your content. DualSpoke does not claim any ownership of, or license to, your uploaded images or your stencil output beyond the limited permission needed to process your image, deliver the stencil back to you, and store your recent stencils in your stencil history. We do not use your content to train AI models.
- How your images are stored. Your uploaded source image is not retained after processing. Your most recent stencils are stored securely in your stencil history, accessible only to you, as described in our Privacy Policy.
You are responsible for making sure your use of any stencil, including how it is applied or sold, complies with the law and respects the rights of others.
The StencilMind name, logo, software, and website are owned by DualSpoke. These Terms do not give you any rights to our brand or software beyond using the service as intended.
5. Copyright Complaints
We respect the intellectual property rights of others and expect our users to do the same. If you believe content processed through StencilMind infringes your copyright, send a notice to support@stencilmind.com including: identification of the copyrighted work, identification of the allegedly infringing material, your contact information, a statement that you have a good faith belief the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you are the rights holder or authorized to act for them, and your physical or electronic signature.
We will review complaints and take appropriate action, which may include removing content and terminating the accounts of repeat infringers.
6. Subscriptions, Conversions, and Billing
StencilMind is offered as a monthly subscription. Each subscription tier includes a set number of conversions per billing period.
- Subscriptions are billed monthly, in advance, to your chosen payment method, and automatically renew each month until you cancel. You can cancel at any time as described in Section 8, and cancellation stops all future billing.
- Payments are processed by our third-party payment processor, Stripe. Your payment details are provided directly to the processor and are subject to its terms; we do not see or store your card number.
- Conversions apply to the current billing period. Unless a specific plan states otherwise, unused conversions do not roll over to the next period.
- A “conversion” is counted when you submit an image for processing. Because each conversion uses real processing resources, a conversion is considered used once it is run, whether or not you are satisfied with the result.
- We may change pricing or plan limits in the future. If we change the price of your plan, we will give you notice by email before the change takes effect, and the new price will apply to your next billing period.
Pro and Expert plans are licensed for use by one individual artist. Studio and Studio Pro plans are licensed for the number of seats included in that tier, shared among the artists at that shop. Account credentials should not be shared beyond the scope of your plan. We do not technically enforce this through device or location checks. Instead, each tier's conversion allowance is sized for that level of individual or team use, so sharing an account beyond its intended scope will exhaust your conversions faster and is not a way to get more value out of a lower tier.
7. Refunds
We do not provide refunds on conversions that have been run. Once a conversion has been run, it is used and is not refundable.
If you cancel your subscription, billing stops at the end of your current period. Cancellation does not refund the current period. You keep access to your plan and any remaining conversions until the end of the period you have already paid for.
This refund policy applies except where a refund is required by applicable law.
8. Cancellation and Account Deletion
You may cancel your subscription or delete your account at any time. Cancellation stops all future billing. Deleting your account removes your account data, including your stored stencil history, as described in our Privacy Policy.
We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the service. Where the reason is not a violation by you, we will give reasonable notice when we can.
9. Service Provided As Is
StencilMind is provided on an “as is” and “as available” basis. We work hard to make it useful, but we do not promise that the output will meet your needs for any specific purpose.
- AI processing results vary depending on the input image. The quality, accuracy, and detail of a stencil depend heavily on the image you upload.
- We do not guarantee that any stencil will be suitable for any particular tattoo, style, size, printer, or transfer method.
- We do not guarantee that the service will always be available, error-free, or uninterrupted.
- Stencil history is a convenience feature, not a backup service. Older stencils are automatically deleted as new ones are created, so download and save any stencil you want to keep.
To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
Please read this carefully, because it limits what we are responsible for.
StencilMind is a tool that produces a digital stencil image. What happens after that, including how a stencil is printed, transferred, sized, or applied to skin, is outside our control and is your professional responsibility.
To the fullest extent permitted by law, DualSpoke is not liable for:
- The outcome of any tattoo, including how it looks once applied
- Sizing errors, scaling issues, or incorrect dimensions in printing or transfer
- Failures in printing, thermal transfer, or stencil paper
- Any harm, injury, or result arising from applying a stencil to skin
- Loss of stencils that rotated out of your stencil history before you downloaded them
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of data, profit, or business
To the fullest extent permitted by law, our total liability to you for any claim relating to the service is limited to the amount you paid us for the service in the three months before the claim arose.
Some jurisdictions do not allow certain limitations or exclusions of liability, so some of the above may not apply to you. In that case, our liability is limited to the maximum extent permitted by law.
11. Your Responsibility and Indemnification
You agree to be responsible for your use of StencilMind. To the extent permitted by law, you agree to cover and hold us harmless from any claims, damages, or costs (including reasonable legal fees) that arise from your violation of these Terms, your misuse of the service, or your infringement of someone else's rights, including uploading images you did not have the right to use.
12. Changes to the Service
We may add, change, or remove features of StencilMind over time. We may also suspend or discontinue the service. We will try to give reasonable notice of significant changes that affect you.
13. Changes to These Terms
We may update these Terms from time to time. When we make a material change, we will notify you by email and update the “Last updated” date above. Your continued use of StencilMind after a change takes effect means you accept the updated Terms. If you do not agree, you should stop using the service and may cancel your account.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of laws rules. You agree that any dispute relating to these Terms or the service will be handled in the state or federal courts located in Wyoming, and you consent to the jurisdiction of those courts. This applies to the extent permitted by the law that applies to you.
15. General
If any part of these Terms is found to be unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver of our right to enforce it later. You may not assign or transfer these Terms or your account without our prior written consent; we may assign these Terms in connection with a merger, acquisition, sale of assets, or corporate reorganization. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the service.
